The Technical Building Inspection; better known by its acronym ITE, is a technical control to which must be submitted every so often the buildings.
Buildings older than 50 years old, unless the Autonomous Communities set different times in their regulations, intended for residential use in the municipalities indicated in the third additional provision, must be subject, depending on their age, of a periodic technical building Inspection that ensures its excellent condition and due conservation, and that meets, at least, the following requirements:
- Evaluate the adequacy of these properties to the legally enforceable terms of safety, health, accessibility and decoration.
- Determine the works and conservation works that are required to maintain the properties in the legally required state, and the time indicated for that purpose.
The actions contained in this article will be applied in the form, terms and conditions that regulate the Autonomous Communities. Municipalities may establish their activities within the framework of state and regional minimums.
The Technical Building Inspections carried out on behalf of the community or group of communities of owners that refer to the whole of a building or real estate complex will extend its effectiveness to every one of the existing premises and homes.
When the deficiencies are made of the Technical Building Inspection, the effectiveness of the document accrediting the same, in order to justify the fulfillment of the legal duty of conservation referred to the Land Law, will be conditioned to the certification of the realization effective of the works and conservation works required to maintain the property in the legally required state, and in the time indicated for that purpose.
Third additional provision. Application of the obligatory technical building inspections.
The determinations contained the technical building inspections will only be applicable in municipalities with a population higher than twenty-five thousand inhabitants unless the Autonomous Communities set other population standards and in those that the Administrations include in the areas or urban environments that delimit.
The Autonomous Communities, when circumstances so advise, may provide for the application of determinations relating to the technical building inspection to municipalities not included in the previous section, and such a case, establish exceptions to the compliance of individual buildings according to their typology or its practical use.
Third final provision. Entry into force
This law will come into force on the day of its publication in the “Official State,” except about the technical building Inspection, which will take effect one year after its publication. . “
Apart from those established, the different ordinances set the minimum periodicity with which the buildings must pass the Technical Building Inspection, which vary according to the city and the age of the property.
Likewise, they establish that the obligation to carry out the building Iipection corresponds to the owners of the building, who must hire an independent technician or certified technical building inspection entity, in order to issue a report, stating the state of conservation of the same, and if it is necessary, or not, to carry out conservation rehabilitation works.
